Birth-Right Retreat – Terms and Conditions
Effective Date: November 6, 2025
These Terms and Conditions (the “Terms”) govern your registration for and participation in the Birth-Right Retreat (the “Retreat”), operated by Kin-to-Kin (“Organizer,” “we,” “us,” or “our”). By registering for, paying for, or attending the Retreat, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
1. Registration and Payment
1.1 Reservation of Space
Your space in the Retreat is secured only upon receipt of full payment or a confirmed payment plan.
1.2 Advance Financial Commitments
You acknowledge that the Retreat venue, accommodations, facilitators, and related services must be secured and paid for well in advance of the Retreat dates. Your payment contributes to expenses that are non-recoverable by the Organizer.
2. Refund and Cancellation Policy
2.1 All Sales Are Final
All payments made toward the Birth-Right Retreat are non-refundable and non-transferable, including deposits, partial payments, and full payments.
2.2 No Refunds for Non-Attendance
No refunds will be issued for failure to attend, early departure, late arrival, illness, injury, personal emergencies, travel disruptions, dissatisfaction with the Retreat, or any other reason.
This policy reflects the non-recoverable nature of venue, food, and accommodation costs as further described in Section 6.
2.3 Acknowledgment of Policy
You expressly acknowledge that this strict non-refundable policy is necessary because retreat-related costs must be paid for and secured well in advance of your arrival.
2.4 Organizer Cancellation
If the Organizer cancels the Retreat, the Organizer’s sole obligation is limited to a refund of the Retreat fee paid. The Organizer shall not be responsible for any additional costs, including but not limited to travel, accommodations, or lost income.
3. Force Majeure
The Organizer shall not be liable for any failure or delay in performance due to events beyond reasonable control, including but not limited to acts of God, natural disasters, fire, flood, severe weather, pandemics, public health emergencies, government orders or restrictions, war, terrorism, civil unrest, labor disputes, power outages, or failures of utilities or transportation systems (“Force Majeure Events”). In such circumstances, refunds are governed solely by Section 2.4.
4. Nature of the Retreat
4.1 Educational and Experiential Purpose
The Retreat is offered for educational, experiential, and personal growth purposes only.
5. Code of Conduct
5.1 Respect and Responsibility
Participants are expected to engage respectfully with facilitators, staff, and fellow participants.
5.2 Removal Without Refund
The Organizer reserves the right to remove any Participant whose behavior is disruptive, unsafe, or harmful to space, themselves or others. No refund will be issued in such cases.
6. Limitation of Liability
6.1 To the fullest extent permitted by law, the Organizer shall not be liable for any indirect, incidental, consequential, special, or punitive damages.
6.2 To the fullest extent permitted by law, the Organizer’s total liability for any claim arising out of or related to the Retreat shall not exceed the total amount paid by the Participant for participation in the Retreat. The Participant further acknowledges and agrees that a substantial portion of the Retreat fee is allocated to costs for food, accommodation, venue rental, and related services, all of which are non-recoverable, non-refundable, and committed in advance, and that the Organizer shall not be liable for the loss of or reimbursement of such costs under any circumstances except as expressly stated in these Terms.
6.3 Third-Party Providers
The Organizer is not responsible for the acts or omissions of third-party service providers, including venues, accommodation providers, or transportation services.
7. Confidentiality
Participants agree to respect the privacy and confidentiality of other participants. Personal stories, shared experiences, or disclosures made during the Retreat may not be shared outside the Retreat without explicit written permission.
8. Photography, Audio, and Video Recording
The Organizer may photograph, audio record, or video record the Retreat for promotional, educational, or archival purposes. If you do not wish to be recorded, you must notify the Organizer in writing prior to the Retreat.
9. Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the Province of BC., Canada, without regard to its conflict of law rules. The Retreat itself will take place in Mexico; participants are responsible for complying with local laws and regulations while attending. The parties irrevocably attorn to the jurisdiction of the courts of BC for any dispute arising under this Agreement.
10. Entire Agreement
These Terms, together with the Waiver, constitute the entire agreement between the Participant and the Organizer regarding participation in the Retreat and supersede all prior communications or agreements, whether written or oral.
11. Voluntary Participation
I acknowledge that my participation in the Birth-Right Retreat (the “Retreat”) is voluntary and may involve emotional, psychological, physical, somatic, spiritual, ancestral, or intergenerational experiences.
12. Assumption of Risk
I knowingly and voluntarily assume all risks associated with participation, whether known or unknown, foreseeable or unforeseeable, including emotional distress, psychological discomfort, physical injury, illness, or other harm.
13. Participant Acknowledgment of Deep Emotional and Ancestral Work
I acknowledge that the Retreat may involve deep emotional inquiry, ancestral or intergenerational exploration, altered states of awareness, or somatic processes that may be intense or activating. I accept responsibility for my own pacing, boundaries, and participation, and understand that I may pause, modify, or withdraw from any activity at any time.
14. Health Representation
I affirm that I am physically, mentally, and emotionally capable of participating. I understand that the Retreat is not a substitute for medical, psychological, psychiatric, or therapeutic care, and that I am responsible for seeking outside professional support if needed.
15. Release of Liability
To the fullest extent permitted by law, I release, waive, and discharge the Organizer and all related parties from any and all claims arising out of or related to my participation in the Retreat.
16. Indemnification
I agree to indemnify and hold harmless the Organizer and their representatives from any claims, liabilities, damages, losses, or expenses arising from my participation or breach of this Waiver.
17. No Guarantees
I acknowledge that no specific outcomes or results are guaranteed.
18. Changes and Amendments
We reserve the right to modify this Agreement or its terms related to the Services at any time. When we do, we will revise the updated date at the bottom of this page. We may also provide notice to you in other ways, such as through the contact information you have provided. An updated version of this Agreement will be effective immediately upon posting the revised Agreement unless otherwise specified. Your continued use of the Services after the effective date of the revised Agreement (or such other act specified at that time) will constitute your consent to those changes.
19. Acceptance of these Terms
You acknowledge that you have read this Agreement and agree to all its terms and conditions. You agree to be bound by this Agreement by using and using the Services. If you do not agree to abide by the terms of this Agreement, you are not authorized to access or use the Services
20. Electronic Execution
I agree that the checkbox acceptance constitutes a legally binding signature to the fullest extent permitted by law.
